Terms of Service

1. Acceptance of Terms

By accessing or using BazaarBay ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and BazaarBay. BazaarBay reserves the right to modify these Terms at any time; continued use of the Platform after changes constitutes acceptance.

2. Nature of the Platform

BazaarBay is a decentralized peer-to-peer marketplace that facilitates transactions exclusively through cryptocurrency. The Platform does not custody, hold, or control user funds. All payments are processed directly between buyers and sellers via on-chain transactions. BazaarBay does not act as a financial institution, money services business, or payment processor.

BazaarBay provides infrastructure and dispute resolution tooling and does not guarantee the performance of any vendor or the quality of any listing.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify BazaarBay immediately of any unauthorized access. BazaarBay will not be liable for any loss arising from your failure to protect your credentials.

4. Cryptocurrency Payments

All transactions on BazaarBay are denominated and settled in cryptocurrency. You acknowledge that cryptocurrency transactions are irreversible, pseudonymous, and subject to significant price volatility. BazaarBay is not responsible for losses arising from exchange rate fluctuations, transaction delays, blockchain network fees, or failed on-chain transactions.

You are solely responsible for providing accurate wallet addresses. Transactions sent to incorrect addresses cannot be recovered by BazaarBay. By initiating a payment, you confirm you have verified the destination address.

BazaarBay supports multiple cryptocurrency networks. You are responsible for sending payments on the correct network. Cross-chain errors resulting in lost funds are not recoverable by BazaarBay.

5. Escrow Service

BazaarBay offers an escrow service for eligible transactions. When escrow is used, buyer funds are held in an escrow wallet until delivery is confirmed or a dispute is resolved. BazaarBay acts solely as a neutral facilitator and does not exercise discretionary control over escrowed funds outside of the dispute resolution process.

Escrow release timelines, dispute windows, and arbitration outcomes are governed by the escrow policy in effect at the time of purchase. BazaarBay's arbitration decisions during disputes are final and binding for on-platform resolution, but do not waive any party's legal rights.

6. Vendor Obligations

Vendors are solely responsible for the accuracy of their listings, the legality of the items or services offered, fulfillment of orders, and compliance with all applicable laws. Vendors must not misrepresent the nature, quantity, or condition of any listing.

Vendors agree not to list, sell, or facilitate the transfer of any items or services that are illegal under applicable law, including but not limited to controlled substances, weapons, stolen goods, counterfeit products, and any material that exploits minors. Violation of this provision will result in immediate account termination.

7. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose or in violation of any applicable law or regulation
• Engage in market manipulation, wash trading, or fraudulent activity
• Harass, threaten, or harm other users
• Use automated scripts or bots to interact with the Platform without prior written consent
• Circumvent or attempt to circumvent any security, access control, or anti-fraud measure
• Launder, obscure, or facilitate the movement of proceeds of crime
• Engage in any form of money laundering, terrorist financing, or sanctions evasion

8. Prohibited Items

The following items and services are strictly prohibited from being listed, sold, or facilitated on the Platform. This list is non-exhaustive and BazaarBay reserves the right to remove any listing at its sole discretion:

• Illegal firearms, ammunition, explosives, or weapon modifications
• Controlled substances, narcotics, or precursor chemicals regulated under applicable law
• Stolen goods, stolen financial data, or stolen account credentials
• Counterfeit currency, forged documents, or fake identification
• Malware, ransomware, exploits, or offensive hacking tools intended for unauthorized use
• Pornographic or sexually explicit material of any kind
• Any material that sexually exploits, depicts, or endangers minors
• Human trafficking, forced labor, or services facilitating exploitation of persons
• Toxins, poisons, biological agents, or hazardous materials
• Services designed to facilitate fraud, phishing, or identity theft
• Goods or services subject to international sanctions or export controls

Vendors found listing prohibited items will have their accounts permanently terminated.

9. Fees

BazaarBay charges platform fees on transactions as described in the current fee schedule published on the Platform. Fees are subject to change with reasonable notice. Network (gas) fees are separate and paid directly to the blockchain network; BazaarBay does not control or profit from network fees.

10. Dispute Resolution

In the event of a dispute between a buyer and vendor, BazaarBay provides an internal dispute resolution process. Users must first attempt to resolve disputes directly before escalating to BazaarBay. BazaarBay's decision in an escalated dispute is final for purposes of the escrow release but does not preclude either party from pursuing legal remedies independently.

BazaarBay reserves the right to suspend or terminate accounts found to be acting in bad faith during the dispute process.

11. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. BAZAARBAY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF MALICIOUS COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BAZAARBAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

BazaarBay's total cumulative liability for any claim arising under these Terms shall not exceed the fees paid by you to BazaarBay in the thirty (30) days preceding the event giving rise to the claim.

12. Termination

BazaarBay reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms, poses a risk to other users, or for any other reason at BazaarBay's sole discretion. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall do so.

13. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BazaarBay regarding your use of the Platform and supersede all prior agreements or understandings.
